1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and DreamSphere.in ("we," "us," or "our"), concerning your access to and use of the DreamSphere.in WhatsApp engagement platform as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Service").

You agree that by accessing the Service, you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

As DreamSphere.in is an invite-only platform, access is granted at our sole discretion. We reserve the right to refuse or revoke access to any user at any time.

2. Service Description

DreamSphere.in provides a premium, AI-powered platform for managing WhatsApp communications using Meta's official API. Features include message management, AI-driven insights, automation, and analytics (the "Features").

3. User Registration and Accounts

To use the Service, you must be invited and subsequently register for an account. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

4. Acceptable Use

You may not access or use the Service for any purpose other than that for which we make the Service available. The Service may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the Service, you agree not to:

• Systematically retrieve data or other content from the Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Use the Service in any way that is fraudulent, or has any unlawful or fraudulent purpose or effect.
• Transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam) via WhatsApp through our Service.
• Violate WhatsApp's Commerce Policy or Business Policy.
• Engage in any activity that interferes with or disrupts the Service.

5. Fees and Payment

Access to DreamSphere.in is subject to subscription fees as agreed upon during the invitation and onboarding process. All fees are non-refundable except as required by law or as explicitly stated in your service agreement.

6. Intellectual Property Rights

Unless otherwise indicated, the Service is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.

7. Term and Termination

These Terms shall remain in full force and effect while you use the Service. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICE (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OR OF ANY APPLICABLE LAW OR REGULATION.

8. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Governing Law

These Terms and your use of the Service are governed by and construed in accordance with the laws of India, applicable to agreements made and to be entirely performed within India, without regard to its conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the courts in Noida, Uttar Pradesh.

10. Changes to Terms

We may modify these Terms at any time. We will provide notice of such changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such posting constitutes your acceptance of the modified Terms.
